What Everett spends on outside lawyers
From our new watchdog page: Need to Know
(Click through to continue.)
11-year total: $16,579,669; average per year: $1,507,242
"Like most legal firms, ours reaches a point where we need expertise in areas and if we don't have that expertise or an issue is extremely complicated, that's when we go to outside counsel," Iles said.
The addition of three assistant city attorneys lessened the need to hire outside lawyers in 2009 and 2010. Today the city's civil division employs a city attorney, six assistant city attorneys, a risk manager and an administrative assistant. In 2010, salaries and benefits totaled $1,080,882.
But with outside private lawyers charging the city more than $400 an hour, even dashing off an email or reading a fax quickly becomes pricey. Below is a selection of line items from attorney bills.

We WON Court of Appeals No. 58250-0!! Reported at 142 Wash. App. 291, 174 P. 3d 1198. Further details at the bottom of Writ of Prohibition Against Contempt Prosecution web page!
Some Practical Advice for Support Contemnors in the State of Washington.
A Way to Walk a Mile in a Noncustodial Parent's Moccasins.
Please check out the litigation listed toward the bottom of the web page Knight v. State Writ of Prohibition Against Contempt Prosecution where I was forced to file a Motion to Modify Commissioner's Decision citing Antipeonage Act because the State of Washington imposed a court order that is a direct violation of the Antipeonage Act, requiring me to maintain at least 30 hours of work per week or make 3 job contacts. Therefore, I display my Brief of Appellant because this is an issue of extreme public importance for which the public should be aware.
My latest Reply Brief of Appellant provides the answers to California's Moss v. Superior Court, the Ninth Circuit's Ballek, and Hawaii's new Child Support Enforcement Agency v. Doe, No. 24457, (Hawaii, December 27, 2005) 109 Hawaii 240, 125 P. 3d. 461, each an obscenity against the Rule of Law.
Petition for Writ of Certiorari to the United States Supreme Court is considered filed as of the date I mailed it, August 8, 2007, within 90 days of June 6, 2007. It is docketed as No. 07-184.
One analogy to illustrate the absurdity of the proposition that choice of employer avoids finding of involuntary servitude is with Washington's Death Penalty statute, RCW 10.95.180(1) grants the condemned a choice: lethal injection or hanging. No one seriously argues that merely because the condemned has a choice in his demise, there is no death penalty. However, California's Moss v. Superior Court, the Ninth Circuit's Ballek, and Hawaii's Doe uses this precise logic: if the peon has a choice of employer, there is no involuntary servitude!
Patently absurd, of course!

Not to be outdone, we are announcing our own billboard contest!

Allow to me let you in on a dirty little secret here. Consider this: Say you are a judge in Washington's court system. Or any other court system actually, but Washington is the one I am most familiar with. We all know about the incredible and universal gender bias in family law, and the absolute lack of respect for noncustodial parents as human beings. Observing this is like observing that the sky is blue. But it is just not credible that ALL of our judges are THAT BIGOTED. SOMETHING is placing the thumb on the scales of justice here, that is the only explanation that makes sense! And here is what it is: As a judge, you know that if you make a ruling that offends certain elements in our society you will be BORKED! In Washington, there are two primary means of borking a judge. 1) Putting up credible sounding candidates against your re-election when judges who NEED to be removed for their refusal to enforce Constitutional rights of politically incorrect litigants (meaning noncustodials and others) never face a challenger. Judge Jeanette Burrage suffered from that fate, and from her own foolishness in admonishing female attorneys for wearing pantsuits instead of dresses. 2) A campaign of judicial conduct complaints. Justice Richard Sanders has experienced this. Power Structure just does not like his dissents, but what saves him is that he is popular with the voting public, the only thing that comes even close to frightening the Power Structure. Notice I use capital letters. Everyone in Washington smarter and more observant than a doorknob knows we have one, even if we cannot "prove" it. An organization with access to, say, numerous divorce files without having to spend hours at the courthouse looking them up, would be in a perfect position to organize a CAMPAIGN of Judicial Conduct Commission complaints against a judge who pissed them off. Litigants in these divorces unhappy with this particular judge will be happy to fill out and file these complaints when prompted. And because judicial conduct complaints are mostly SECRET, we do not know and cannot verify, if there is ACTUALLY A CAMPAIGN of such complaints against a particular judge. Because every judge is a human being, and therefore not perfect, there will be at least one incident described in these complaints, where the judge messed up bad enough to warrant discipline!
Same thing with lawyers, which might explain their fear of FORCEFULLY representing noncustodial parents and even to mention the Antipeonage Act in the same context as family law.
So what do we do? Answer is to realize that the thumb on the scales of justice is political, and is motivated by some unreasoning hatred of noncustodial parents, and/or the Seven Deadly Sins including avarice (fancy word for greed) and there is only one thing we NEED to do in ADDITION to everything else we do: Put OUR thumb on the other side of the scales of justice.
Judicial Conduct Commission complaints, folks. Bar complaints against support enforcer attorneys. EVERY time they give you cause to file such complaints! Clue: What works are lies, excuse me, "misstatements of fact" ;-), told by attorney to court that were uncorrected and repeated after you asserted that the truth is otherwise. Back it up with evidence. That gets the disciplinary counsel fired up!

Judge Kennedy went to her hearing before the Angels at the Pearly Gates on September 16, 2005
Her replacement, elected by 30% of the voters in Snohomish County to the Court of Appeals is Stephen Joseph Dwyer. And he abused the voters' trust in the Antipeonage Act appeal by signing a poorly written unAmerican unpublished decision that is so bad as to constitute a violation of the Code of Judicial Conduct.
On the copy of the decision mailed to me, I recognize the signatures of Judges Baker and Becker, see below, she is a former judge in the Skagit and Whatcom County systems. I believe the other signature is that of new Judge Stephen Joseph Dwyer. He is the only Judge on the Court of Appeals Division One roster whose last name begins with the letter D. This decision has the logic of a finding that just because you can establish six feet, to claim a fathom is to bring a frivolous claim. To wit: the difference between imprisonment for debt and imprisonment for violating a court order to pay money is equal to the difference between six feet and a fathom. And equal to the difference between peonage and a court order requiring 30 hours of work per week or 3 job contacts.
The short version of what the Court of Appeals said:
A homosexual couple can argue that they have as much right to get married as a heterosexual couple under the 14th Amendment Equal Protection Clause and their argument will not be considered frivolous. The proposition that a woman has the right to murder her unborn child is not only not frivolous, but considered the Supreme Law of the Land. But for a non-custodial parent to challenge a court order requiring 30 hours of work per week or a job search as declared null and void by the Antipeonage Act? Outside of California, that is considered "wholly frivolous" even though the California courts found Brent Moss and his attorneys to have acted in good faith.
Can there be any doubt that our court system is infected with an unreasoning bias against a class of citizens that amounts to bigotry of Nazi and Ku Klux Klan proportions? These judges are no better than the jackass who shot up the Jewish Federation of Greater Seattle. They do with their pen and positions of power and trust what Haq did with a gun.

Under Article IV Section 7 of the Washington Constitution, a party to a case in a superior court has to consent in writing before a pro tem judge (with exceptions) can hear his case or render any decision. If a party objects, the pro tem must recuse.
There is a story about the sound recordings of hearings before the Commissioners being deleted. Thanks Washington Shared Parenting

Jacalyn Dean Brudvik, WSBA 15238, DOB July 25, 1953, white female, Mukilteo, Washington 98275 DOB July 25, 1953 Voted by absentee on November 2, 2004 Voted again on November 8, 2005 and November 3, 2009 Snohomish County No. 01-2-07233-0 defendant commercial; Snohomish County No. 83-3-00799-4 respondent domestic relations; Snohomish County No. 85-9-01405-1 judgment creditor domestic order of contempt against ex-husband for accrued child support of $2,209.00 with attorney's fee of $250.00 awarded to Cogdill Deno Millikan and Carter law firm;
Here is my recommendation: If you or your client are being prosecuted for noncompliance with a support order, or for a modification of an existing support order and you see Jacalyn Brudvik's signature on any of the paperwork, I suggest that you bring a motion to disqualify her for cause. Why? Aside from the fact that the whole thing is unconstitutional on its face and constitutes the Crime of Peonage, therefore, all's fair, Jacalyn Brudvik has no business being involved in family law cases, either as a commissioner or as an attorney! A commissioner obviously has a great deal of discretion within her official duties. These are decisions best made by those who are "completely neutral". Of course, they are not, but at least they should have the appearance of being neutral. When such a person has a personal history with the subject of the case before her, i.e. family law and child support enforcement, that personal history is going to color her decision making, and indeed, she will have a personal stake in the outcome of whatever issues arise. This is what is meant by the phrase "conflict of interest". Jacalyn Brudvik could appropriately be hearing criminal cases and non-domestic civil cases, but she is not fit by personal history and personal interest to hear domestic cases as a commissioner.

Former Elected Prosecutor Seth Ray Dawson, WSBA 7135, Mukilteo, Washington 98275. DOB June 3, 1951 Voted by absentee on November 2, 2004 Voted again on November 8, 2005 and November 3, 2009 Now at Compass Health Law Firm in Everett, Washington. Snohomish County No. 85-9-03345-4 judgment creditor summary judgment for statutory attorney's fees payable to the County for $129.00; Snohomish County No. 93-9-00201-1 judgment debtor for costs on appeal of $237.00; Snohomish County No. 93-9-01795-6 judgment creditor for costs on appeal of $497.79 paid; The thing that I remember about this guy was that back in 1988 when the Support Schedule Law with its unreasonable economic table was being passed by the Legislature he, as Snohomish County Prosecutor, had a real "hard on" for this bill. It was like he badly wanted to increase the workload of his deputy prosecutors in the support contempt cases. God forbid that any of them would be freed up to go after real criminals due to a lack of case referrals from the Division of Child Support! As I keep trying to tell taxpayers, Dig Down Deep!

There is a David James Mace who has been busy with numerous filings in Pierce County including felony convictions in Pierce County Superior Court. I seriously doubt he is the same guy as this lawyer. Perhaps trying to get blood out of noncustodial father turnips made this man sympathetic to the homeless. If so, point in his favor.

Problem with going after support contemnors, sometimes there's no blood left in the turnip! Note to Robin Hood: after you've stolen enough from the rich, they ain't rich no more! This is what is meant by the phrase: "judgment proof".
Perjury and interference with official proceedings are set forth in chapter 9A.72 RCW and resisting arrest and obstructing governmental operations are set forth in chapter 9A.76 RCW.
